Expunction vs. Nondisclosure: What's the Difference?

Two Distinct Paths

Many people confuse expunction and nondisclosure, but they are very different under Texas law.

An expunction orders the destruction of all records of an arrest. Once granted, the incident is legally erased. You can truthfully deny it ever happened on job applications.

An order of nondisclosure , on the other hand, seals the record from the general public (like private background check companies) but leaves it accessible to law enforcement, state agencies, and certain licensing boards. Usually, cases that ended in deferred adjudication are eligible for nondisclosure, whereas outright dismissals or acquittals qualify for expunction.

Navigating the Texas legal system can be complex. At Expungement.Legal, we handle the entire process from start to finish. Our team of attorneys knows exactly how to ensure your record is thoroughly wiped from government and private databases alike.
