Can You Expunge a DWI in Texas?

The DWI Exception

Texas treats DWI offenses much more harshly than many other crimes. Generally, you cannot expunge a DWI conviction. You also cannot expunge a DWI if you received probation (even deferred adjudication, which isn't typically available for DWIs anyway).

However, you can expunge a DWI arrest if the charges were entirely dismissed, if you were acquitted at trial, or if it was filed as a Class C minor in possession and later dropped. Recently, Texas also passed "Second Chance" laws allowing certain first-time DWI convictions to be sealed via an Order of Nondisclosure, but not strictly expunged.
